This appeal has been filed against the order dated 06.07.2024 passed by Additional Sessions Judge/Special Judge, SC/ST Act, Lakhimpur Kheri in Complaint Case No.238/2022, the operative part of the order is extracted below:- " पसततत पकरण मम पकककरर कक मधय जममन कक वववकद हह। ववपकम स 0-1 कक उम 48 वरर बललकयम गयम हह तथक 3-4 अजकत वयवक बतकयक गयक हह। पररवकवदनम नक घटनक कक समय वकसम अनय वयवक कक हहनक सक पपणरतत इनककर वकयक जबवक धकरक-202 द०प०स मक परमवकत सकवकयर नक सवय दकरक घटनक सथल पर हहनक और घटनक आआखर सक दकखनक कहक हह। पररवकद पत व धकरक-200 द०प०स० कक बयकन मम पररवकवदनम नक यह कहक वक जब घटनक हहई तब उसक उसकक पवत लकनक आ रहक थक, उनहरनक बचकयक, जबवक पम०डबलप०-3 कक रप मक परमवकत सककम अमर सससह रहदकस नक अपनक बयकन अ० धकरक-202 द०प०स० कक बयकन मम कहक वक वह अपनक घर पर थक और शहर पर जब बकहर वनकलक तह उसकक पतनम कक सकथ घटनक हह रहम थम। वदनकसक 04.06.2022 कक ससदरर मक धकरक-202 द०प०स० मक कहई सककय पसततत नहह वकयक गयक। थकनक कक आखयकनतसकर कहई घटनक हहनक नहम पकयक गयक। जममनम रसजश हहनक कक ककरण यह मतकदमक सलखकयक गयक हह। उक तथयर कक अलकवक अनय ऐसक कहई तथय पसततत नहह वकयक जक सकक, जह यह दवशरत करम वक अवरयतकगण दकरक पररवकवदयक कक सकथ कहई आपरकसधक कक तय वकयक गयक हह। अतत मकमलक कक तथयर एव पररससथवतयर कह दवषगत रखतक हहए ववपकमगण कह ववचकरण हकतत तलब वकयक जकनक हकतत पयकरप आधकर नहम हह। तदनतसकर पररवकवदनम कक पररवकद पत वनरसत वकयक जकनक यहगय हह। आदकश तदनतसकर पसततत पररवकद वनरसत वकयक जकतक हह। पतकवलम वनयमकनतसकर दकसखल दफतर हह।" A perusal of the record as well as the impugned order shows that there appears to be a civil dispute between the parties which has been taken note by the learned court below while passing the impugned order. The complainant appears to have encroached the gram sabha land which the accused wanted to remove. Perusal of the impugned order further shows that while passing the impugned order the learned court below has carefully gone through the statement of the complainant under Section 200 Cr.P.C. and the statement of witnesses under Section 202 Cr.P.C. as well as the complaint itself. It appears that no evidence has been produced by the complainant under Section 202 Cr.P.C. regarding the incident which took place on 04.06.2022 thus, there appears to be no illegality in the impugned order, the appeal is devoid of merits and is accordingly dismissed.
