Petitioner was employed in Bhimtal Gas Agency, run by Kumaon Mandal Vikas Nigam Limited, as daily wage employee. He was disengaged in 2023 on account of a charge under Section 6A of Essential Commodities Act, 1955. 3. According to petitioner, the charge has been dropped and the cylinders which were seized have now been released to the persons concerned, therefore, now there is no adverse material against him based on which petitioner can be denied re-employment. 4. In this writ petition, petitioner has sought the following reliefs: “1. To issue a writ, order or direction in the nature of mandamus for reinstating the petitioner back in the services, as the duty was not given to him even after the acquittal from the charges of dishonesty against the petitioner by the order of District Magistrate dated 23.04.2024, as a person against whom the inquiry was set up with the petitioner and charges were proved was reinstated in services by the respondents. 2. To issue a writ, order or direction in the 2025:UHC:9244 nature of mandamus directing the respondents to decide their representation with speaking order.” 5. Having regard to the reliefs sought, this Court thinks that ends of justice would be met if petitioner is permitted to approach the Competent Authority by making representation. 6. The writ petition is, accordingly, disposed of with liberty to petitioner to make fresh representation. If he makes such representation within two weeks from today, Managing Director, Kumaon Mandal Vikas Nigam Limited, shall look into the matter and pass a reasoned order on petitioner’s representation, within six weeks thereafter.
