Pursuant to the order passed on 15.05.2025, learned Additional Advocate General has handed over a banker’s cheque in the sum of Rs.5500/- drawn in favour of the petitioner, to her learned counsel.

Learned Additional Advocate General has also placed on record copy of office order dated 28.03.2025, rejecting the case of the petitioner for grant of reliefs claimed by her in the instant writ petition. The said rejection is in view of the ‘Himachal Pradesh Recruitment

and Conditions of Service of Government Employees Act, 2024’ (in short ‘the Act’).

Learned counsel for the petitioner submits that in view of the Act and aforesaid office order issued by the respondents on the basis of the said Act, the petitioner be permitted to withdraw this writ petition with liberty to file afresh in accordance with law for the redressal of her grievances including against the consideration order as well as the Act. Learned counsel further submits that the petitioner would be satisfied in case she is permitted to prefer a representation to the respondents/competent authority for grant of pension within a period of two weeks and thereafter the competent authority be directed to decide the said representation in accordance with the law laid down in State of Himachal Pradesh & Anr. Versus Sheela Devi2 within a time bound schedule Learned Additional Advocate General is not averse to this prayer.

In view of above submissions, this writ petition is though disposed of as withdrawn with liberty to the petitioner to file afresh in accordance with law for the redressal of her surviving grievances, but also by permitting the petitioner to file a representation to the respondents/

competent authority for grant of pension within a period of two weeks from today. In case such a representation is received by the respondents/competent authority within the aforesaid period, the same shall be considered and decided in accordance with law as well as taking into
consideration the above judgment in the case of Sheela Devi2 within a period of six weeks thereafter. The decision so arrived at shall also be communicated to the petitioner.
The writ petition stands disposed of in the above terms, so also the pending miscellaneous application(s), if any.
