2. By way of filing this writ petition, a prayer has been made for issuing directions to the respondents for allotment of land. This Court passed an interim order on 11.03.2025, which reads as under:-
“This writ petition is filed by the petitioner seeking allotment of land pursuant to judgment dated 29.06.2001 passed by the Court of Additional Collector, Second, Alwar in appeal No.12/353: Jumma and another Vs. Karela Singh.
Learned counsel for the petitioners submits that despite direction issued way back on 29.06.2001 to allot another piece of land to Shri Karela Singh, their predecessor-in-interest, no land has been allotted till date.
Learned counsel for the respondents prays for time to complete her instructions. Neither reply to the writ petition has been filed nor, any reason is furnished for non-compliance of the direction issued about 24 years ago. However, in the interest of justice, the respondents are granted five weeks’ time to ensure compliance of the aforesaid direction or to file an affidavit of the Secretary, Department of Revenue, Government of Rajasthan explaining the reasons(s) for non-compliance. List the matter on 21.04.2025 at top of the list as prayed.”
3.
Learned counsel for the respondents submits that in compliance of the aforesaid interim order dated 11.03.2025 passed by this Court, allotment order dated 18.04.2025 has been passed by the Sub-Divisional Officer, Kishangarhbas, Khairthal- Tijara in favour of the petitioners subject to deposition of the requisite amount. Learned counsel submits that the relief sought for in this petition has already been granted, hence under the changed circumstances, this writ petition has become infructuous.
[2025:RJ-JP:16519] (3 of 3) [CW-16075/2013]
4. Considering the above factual aspect of the matter and looking into the allotment order dated 18.04.2025 passed by Sub- Divisional Officer, Kishangarhbas, Khairthal-Tijara, no further cause of action survives with the petitioners to continue with this petition.
5. Accordingly, the writ petition is dismissed as having become infructuous. Stay application as well as all applications (pending, if any) also stand dismissed.
6. However, the petitioners would be at liberty to approach appropriate forum of law, in case any cause of action arises.
