Hon'ble Jaspreet Singh,J. Heard learned counsel for the petitioner. Notice on behalf of respondent nos.1 and 2 has been accepted by the office of Chief Standing counsel. By means of the instant petition, the petitioner seeks a direction for the respondent no.1 to consider and decide the pending application under Rule 109A(1) of the U.P.C.H Rules, 1954 as expeditiously as possible. Having considered the submissions and from a perusal of the material on record including paragraph-19 of the petition where it has been stated that the order passed by the C.O. and the S.O.C have become final but in the same breath and in the same paragraph it is stated that respondent no.3 has already filed a revision, however, it is stated that there is no interim order. Be that as it may, since the matter is already engaging the attention of the respondent no.1 this Court find that there is nothing on record to indicate that the petitioner had informed the Court concerned regarding the aforesaid facts and for seeking expeditious disposal. Accordingly, this Court is not inclined to entertain the petition, at this stage, leaving it open for the petitioner to move an appropriate application before the Consolidation Officer for seeking expeditious disposal, in case, if such application is moved needless to say the court concerned shall consider and decide the same strictly in accordance with law. With the aforesaid the petition is dismissed. It is made clear that in case if any cause of action arises in future this order will not come in the way of the petitioner.
