A case has been registered against the petitioners and others for the offence punishable u/See.20(b)(ii)(B), 25 r/w 8(c) of NDPS Act. 3. Heard learned counsel for the petitioners and the learned Assistant Public Prosecutor representing the respondenVState. 4. Case of the prosecution, in brief, is that, on o9.01.2O25 at about 12.00 noon, on receipt of credible information regarding illegal possession and transportation of ganja, the S.I of Police, along with staff and mediators JoEiiiii 2 ' rushed to sadupakala junction and conducted vehicle checking, one person w'lth scooty bearing no.AP 39 GK 4901 coming from Chintapalli and on seeing police, he turned the scooty and tried to ran away. Then police apprehended him and on enquiry, he disclosed his identity particulars as that of Al and PO'iCe found 2.800 kgs of ganja in his possession. He confessed that he collected the ganja from A2 and A3 and hence the names of the petitioners were included in the F.I.R. PoI|ICe arrested Al and remanded him to judicial custody. During the COurSe Of investigation, POliCe arrested the petitioners on o7.02.2205 on execution Of PT warrants. 5. Heard. PerusedthereCOrd. 6. Learned Assistant Public Prosecutor Submits that major Part Of the investigation is completed except filing of charge sheet for want of RFSL report and prays to dism®lss the pet'ltion. 7. Learned COunSel for the Petitioner Submits that a Crime Came tO be registered on o9.01.2025 and basing On the COnfeSS|lOn Statement Of CO- accused, these petitioners were arrested on o7.02.2025 and since then they have been in judicial custody and the same was not disputed by the learned Ass'lstant Publ'lc Prosecutor. 8. After careful Observation Of the material On record and SubmiSSiOnS made on behalf of both sides, it shows that the petitioners were arrested and remanded to judicial custody on o7.02.2025. Evidently no COntraband has been seized from the possession of the petit'loners. since the accused have been in remand from o7.02.205, this Court found that most Of the <>- 4,. rI,<ff'f' •+++ ++/ \++++++ 3 investigation pertaining to the role played by the petitioners in the commission of the offence would be completed. lt is submitted that the petitioners have permanent abode and there is no possibility of their fleeing away from justice and most of the witnesses are official witnesses and the release of the pet'ltioners would not cause tampering of evidence and hampering of investigation. When ascertained, learned Assistant Public Prosecutor submitted that one antecedent reported against the petitioners. Considering the entire material on record, this Court is inclined to grant bail to the petitioners with some conditions. 7. ln the result, the Criminal Petition is allowed with the fo[[owing conditions: (i) The petitioners/A2 and A3 herein shall be released on their executing a personal bond for Rs.10,000/- (Rupees ten thousand only) each with two sureties for a like sum each to the satisfaction of the learned I Additional District and Sessions Judge-Gum-Special Judge for trial of offences under NDPS Act, Visakhapatnam. (ii) On release, the petitioners shall appear before the Station House Officer concerned on every Sunday between 10.00 a.m. and 12.00 noon, for a period of two (O2) months.
