Neutral Citation No. - 2025:AHC-LKO:6495 Court No. - 8 Case :- WRIT - C No. - 928 of 2025 Petitioner :- Kunnu Singh And Another Respondent :- Addl. Commissioner, Administration Ii, Devi Patan Mandal, Gonda And Others Counsel for Petitioner :- Ajey Singh Counsel for Respondent :- C.S.C. Hon'ble Jaspreet Singh,J. 1. Heard the learned counsel for the petitioners. Notice on behalf of the respondents no.1, 2 and 5 has been accepted by the ofÏce of the Chief Standing Counsel. 2. By means of the instant petition, the petitioners seek quashing of the order dated 06.01.2021 passed by the respondent no.1 in a revision preferred by the private respondent. 3. The record indicates that in a suit instituted by the present petitioners under Section 229-B of the U.P. Z.A. & L.R. Act and interim order was granted directing the parties to maintain status quo. At the initial stage, a revision was preferred by which the matter was remanded and once again after the remand the earlier order was rejected by means of order dated 16.12.2021, a copy of which has been brought on record as annexure no.4. 4. It is the contention of the counsel for the petitioners that against the said order (annexure no.4) the private respondent has filed another revision which is pending before the respondent no.1 and in the garb of the same, the possession of the petitioners are being disturbed. The petitioners have filed a copy of questionnaire as annexure no.5 indicate that the revision is engaging the attention of the respondent no.1 wherein the matter is pending. 5. A specific query was put to the counsel for the petitioners as to whether the petitioners were put in appearance before the revisional court which he answered in the afÏrmative and further submits that only after putting in appearance they have received the copy of the questionnaire but they could not dispute the fact that despite having put in appearance. They have not moved any application/objections or raised any grievance before the revisional court who is already seized of the matter. 6. In view of the aforesaid, this Court is not inclined to entertain the petition leaving it open for the petitioners to raise their grievances before the court where the matter is pending and needless to say that in case if such objections/application is moved, the same shall be considered and be decided on its own merits. 7. Accordingly, the petition is dismissed. Order Date :- 30.1.2025 ank Digitally signed by :- ALI NEWAZ KHAN High Court of Judicature at Allahabad, Lucknow Bench
