Heard learned counsel for the petitioner and learned Standing Counsel. 2. The present petition has been filed with the following relief: "a) Issue a writ of mandamus or a writ, order or direction in the nature of mandamus directing the Respondent no. 1 to 7 to remove illegal encroachment made by the respondent no. 8 from the pond i.e. "ततालताब" situated at Gata no. 705, Khatauni khata sankya- 00412, Village-Deoria Inayat, Pargana- Sadullahnagar, Tehsil-Uttralla, District admeasuring 0.0650 hectare; Balrampur, b) Issue a writ of mandamus or a writ, order or direction in the nature of mandamus directing the Respondent no. 1 to 7 to restore the pond i.e. "ततालताब" situated at Gata no. 705, Khatauni khata sankya- 00412, Village- Deoria Inayat, Pargana- Sadullahnagar, Tehsil- Uttralla, District Balrampur, and develop, maintain the same as recreational spot in the interest of the villagers;" 3. Learned Standing Counsel, based upon the instructions, states that proceedings under Section 67 of the U.P. Revenue Code, 2006 have already been initiated and are pending. 4. In view of the said statement, the present petition is disposed of with a direction to decide the application under Section 67 of the U.P. Revenue Code within a period of 90 days from the date of filing of a certified copy of this order, in accordance with law.
