Neutral Citation No. - 2025:AHC-LKO:6357 Court No. - 30 Case :- CRIMINAL REVISION No. - 128 of 2025 Revisionist :- Shri Vijay Kumar Shukla @ Vijay Kumar Opposite Party :- State Of U.P. Thru. Prin. Secy. Home Deptt. Lko And 3 Others Counsel for Revisionist :- Vineet Kumar Pandey,Ankita Mishra,Pradeep Kumar Tiwari Counsel for Opposite Party :- G.A. Hon'ble Om Prakash Shukla,J. Heard learned counsel for the revisionist and learned A.G.A. for the State. The instant criminal revision is filed against the impugned order dated 20.11.2024 passed by learned Special Judge Ayurved Scam, Lucknow in Sessions Case No.2692 of 2024, Police Station Jankipuram, District Lucknow, whereby application of the revisionist filed under Section 319 Cr.P.C. is rejected on the sole ground by the learned trial court that the alleged accused are not the beneficiary of any dowry as they are relative of ex- wife. Learned counsel for the revisionist submits that the learned trial court has passed the impugned order only on the basis of surmises and conjunctures without giving weight to the evidence on record, which is totally illegal, perverse and without application of judicial mind. On the other hand, learned A.G.A. for the State has opposed the prayer made by learned counsel for the revisionist and submits that the impugned order has correctly been passed by the learned trial Court after considering the entire facts and circumstances of the case, which is totally legal and does not require any interference by this Court. After hearing learned counsel for the revisionist as well as learned A.G.A. for the State, this Court is of the view that the learned counsel for the revisionist has failed to show or satisfy the Court any concrete material or any allegation which is substantiated by any supporting document or evidence, which shows involvement of the said accused. Further, on perusal of rejection order of application filed under Section 319 Cr.P.C., this Court does not find any good ground to interfere in the same, as such, the instant criminal revision is liable to be dismissed. Accordingly, the instant criminal revision stands dismissed. (Om Prakash Shukla,J.)
