Petitioner was elected as Member of Zila Panchayat, Bageshwar in the last election held in the year 2019. Respondent no. 1 challenged his election by filing election petition. In the election petition, learned Additional District Judge, Bageshwar directed for production of Ballot Papers in a sealed cover, vide order dated 30/27.11.2021. Challenging the said order, returned candidate filed this writ petition. 5. Learned counsel for respondent no. 1 and also learned State Counsel submit that term of Member & Chairman of Zila Panchayat, who were elected for five years in the year 2019, come to an end in 2024. Thus, counsels for the respondents submit that the writ petition has become infructuous, after expiry of term of petitioner, as Member. 6. This Court finds substance in the submission made by learned counsel for the respondents. Since petitioner is not a Member of Zila Panchayat any longer, therefore, the reliefs, as claimed in the writ petition, do not survive. 7. Accordingly, the writ petition is dismissed, as infructuous.
