The petitioner claims to have submitted an objection to the provisional assessment notice dated 25.09.2024 by hand and a copy of which is annexed as Annexure No.4, however, it has not been considered in the final assessment notice dated 23.12.2024. 3. Counsel for the Electricity Corporation says that no such application was received, however, the petitioner says that it was served in the office of the Executive Engineer by hand. 4. Without entering into this controversy as the final assessment notice imposes financial liability of Rs.59,124,00/- and it is a case of electricity theft, let the objections of the petitioner contained as Annexure No.4 be considered and a fresh decision be taken accordingly. The impugned final assessment notice shall abide by the fresh decision taken by the Executive Engineer within a period of three weeks. 5. The writ petition is disposed of.
