Heard Sri Birendra Kumar Yadav, learned counsel for the petitioner and the Standing counsel for the respondents. 2. By means of the instant writ petition, the petitioner has sought a direction to the opposite parties to amend the regularization order of the petitioner dated 24th February, 2016 and make it effective from 20.12.2001 and pay pension and other service benefits to the petitioner. It has been stated that the petitioner has also approached U.P. Public Services Tribunal where the contentions of the petitioner was rejected by Chief Engineer i.e. opposite party No.2 vide his order dated 11.3.2020 and the said matter is pending where again the issue which is pending consideration is as to whether the services of the petitioner can be counted for granting him service benefits prior to the date of his regularization. 3. Considering that the issue before the Tribunal as well as in the present writ petition is the same, it would be proper if the petitioner waits for the outcome of the decision of the Tribunal and thereafter, approaches this Court for the prayer made in the present writ petition. 4. Learned counsel or the petitioner, at this stage, submits that he may be permitted to withdraw this petition with liberty to file the same as per the directions given by this Court herein- above. 5.
