2. The petitioner is apprehending his arrest in connection with RC- 05(A)/2012 AHD-R, arising out of Vigilance P.S. ACB No. 10 of 2011, registered under sections 420, 423, 424, 467, 468, 469, 471, 477A, 120B, 109 and 201 of Indian Penal Code and under section 13 (2) read with section 13 (1) (d) of Prevention of Corruption Act, 1988, pending in the Court of learned A.J.C. XVIII- cum-cum-Special Judge, C.B.I, Ranchi.

Learned counsel for the petitioner submits that the petitioner has appeared in the Jharkhand Public Service Commission which was held in the year,
2003. He submits that the petitioner was successful in the examination and he was allotted to the post of Deputy Collector in the State of Jharkhand. He submits that some irregularities have been alleged against the Jharkhand Pubic Service Commission and others and pursuant to that matter has been handed over to the C.B.I by the High Court and the C.B.I investigated the matter and submitted chargesheet in which the petitioner has not been chargesheeted however the learned court has taken cognizance. He submits that allegation in the F.I.R. is that six mark has been added to the petitioner. He further submits that even the six mark is reduced from the total marks obtained by the petitioner, the petitioner is competent to hold the said post of Deputy Collector. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Mr. Prashant Pallav, learned counsel for the C.B.I. opposes the prayer and submits that materials are there in view of that learned court has taken cognizance.
5. Considering that chargesheet is not against the petitioner, the petitioner has been declared successful and he has obtained 790 marks, allegation is that six marks extra have been granted to the petitioner, who has granted six

marks extra to the petitioner, is not clear and it is very difficult to find out how the petitioner obtained six marks extra on his own, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the petitioner above named, is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned A.J.C. XVIII-cum-cum-Special Judge, C.B.I, Ranchi in connection with RC-05(A)/2012 AHD-R, arising out of Vigilance P.S. ACB No. 10 of 2011, subject to conditions as laid down under Section 482 (2) of B.N.S.S,
