The present contempt application has been preferred for the alleged non compliance of the judgment and order dated 1.10.2024. The relevant extract of the judgment and order dated 1.10.2024 is quoted herein below:- "4. Accordingly, considering the fact that application for recall of the order passed under Section 67 of U.P. Revenue Code, 2006 is pending, no direction as sought by the petitioner for eviction from the gaon sabha land can be passed at this stage. However, prescribed authority is directed to expedite the proceedings pending before him expeditiously. 5. With the above, observations / directions, the writ petition stands disposed of." 2. There is no positive direction issued by the Writ Court for deciding the proceedings under Section 67 of U.P. Revenue Code, 2006 not even a direction to decide the same within the statutory period as provided under the Act or Rules and the present contempt application has been filed about three months from the date of making the representation. 3. At this Stage, learned counsel for the applicant has submitted that the applicant may be permitted to withdraw the present contempt application with liberty to approach this Court at the appropriate stage. 4. As such, the present contempt petition is dismissed with liberty to approach this Court at the appropriate stage.
