1. The present appeal arises out of the impugned judgment of conviction and order of sentence dated 07.07.2007 passed by the learned 2nd Additional Sessions Judge, Ambikapur, Digitally signed by SHUBHAM SINGH RAGHUVANSHI Date: 2025.02.06 14:37:09 +0530
2 District Surguja (C.G.), in Session Case No.505/2004 whereby the learned Judge has convicted and sentenced the appellants as under : Conviction Sentence U/s 450 of IPC RI for 3 years and fine of Rs.500/-, in default thereof, 1 month additional RI. U/s 394 of IPC RI for 7 years and fine of Rs.1,000/-, in default thereof, 3 months additional RI. U/s 397 of IPC RI for 7 years U/s 25 (1-B) of the Arms Act RI for 1 year
2. Vide order dated 04.11.2017 of this Court, a report has been called from concerned Jail authority and on 08.11.2017, a report has been received from Central Jail Ambikapur, wherein, it is mentioned that in connection with ST No.505/2004, the Appellants Tingal @ Suresh and Iliyajar @ Pratap after completion of entire jail sentence imposed upon them by the Trial Court released on 07.08.2009 & 15.11.2011 respectively.
3. Learned counsel appearing for the appellants submits that as the Appellants have already been released from jail after completion of entire jail sentence imposed upon them by the Trial Court, therefore, the appeal has now become infructuous.
4. In view of above, the appeal is dismissed as having become infructuous.
