Heard learned counsel for the parties and perused the record. 2. The present petition has been filed with the following prayer:- "1. To issue a writ, order or direction in the nature of mandamus commanding the opp. party no.2 & 3 to take necessary action against the opp. party no. 4 to 8 for making encroachment over the land gata no. 168, area 0.405 hectare and land gata no.389 area 0.356 hectare, recorded as Khalihan (Govt. reserved land) in the revenue record situated at Village Matkhanwa, Pargana & Tehsil Bhinga, District-Shrawasti, in the interest of justice. 2. To issue a writ, order or direction in the nature of mandamus commanding the opp. party no.2 & 3 to remove the illegal encroachment over the land gata no. 168, area 0.405 hectare and land gata no.389 area 0.356 hectare, situated at Village- Matkhanwa, Block- Hariharpurrani, Pargana & Tehsil- Bhinga, District-Shrawasti, made by opp. party no.4 to 8, in the interest of justice." 3. Learned counsel for the respondents based upon instructions states that the proceedings under Section 67 of the U.P. Revenue Code have already been instituted against the encroachers. 4. In view thereof, the present petition is disposed of with direction to conclude the same within a period of 90 days in accordance with law.
