(1) Heard learned counsel for the petitioner, learned A.G.A for the State-respondent nos.1, 2 and 3 and perused the record. (2) In view of the order proposed to be passed, issuance of notice to the Opposite party no.4 is dispensed with. (3) This petition has been filed by the petitioner for the following prayers:- "i) a writ, order or direction in the nature of Certiorari to quash the impugned First Information Report dated 13.08.2024 relating to F.I.R./ Case Crime No.0347 of 2024, under Sections 419, 420, 504, 506 I.P.C. at Police Station Kheri, District Kheri, lodged by the Opposite party no.4 in respect of petitioner which is contained as Annexure No.1 to this writ petition. ii) a writ, order or direction in the nature of Mandamus thereby commanding to the Opposite party nos.1 to 3 not to arrest to petitioner in First Information Report dated 13.08.2024 relating to F.I.R./ Case Crime No.0347 of 2024, under Sections 419, 420, 504, 506 I.P.C. at Police Station Kheri, District Kheri, lodged by the Opposite party no.4 in respect of petitioner." (4) It has been submitted by the learned counsel for the petitioner that the petitioner has not been named in the F.I.R. but the Police is harassing the petitioner who is a law abiding citizen. (5) Learned A.G.A. has produced before this Court the instructions sent by Shri Gaurav Kumar, the Investigating Officer/ the Sub-Inspector of Police Station Kheri, District Kheri, wherein it has been stated that the F.I.R. has been lodged against Puttilal, Narendra Verma, Mahesh and Umesh Pandey and from the investigation which has been carried out upto date, the name of Ram Sanehi has not surfaced in the statement of the witnesses. (6) The instructions are kept on record. (7) This writ petition is disposed of with liberty to the petitioner to approach this Court again in case, the Police harassing in pursuance of the impugned F.I.R.
