Wife has filed this application seeking transfer of divorce suit, filed against her at Family Court, Pauri Garhwal, to Family Court Kotdwar. 4. It is contended that applicant is serving as Headmistress in a Government Primary School at Dwarikhal, which is closer to Kotdwar and the only daughter of the applicant is also residing at Kotdwar with her maternal grandparents and it is not possible for applicant to visit Pauri on each and every date fixed in the divorce suit, therefore, proceedings of divorce suit be transferred to Kotdwar. 5. Mr. M.K. Ray, learned counsel appearing for respondent, on instructions, submits that respondent has no objection against the prayer for transfer made by the applicant (wife). He therefore, submits that the transfer application may be allowed and the divorce suit can be transferred from Pauri to Kotdwar. 6. In view of the concession made by learned counsel appearing for the respondent, Transfer Application is allowed. Proceedings of Original Suit No. 82 of 2022, pending before Family Court 2025:UHC:4943 Pauri Garhwal is transferred to Family Court at Kotdwar. This Court hopes and expects that the transferee Court shall make endeavour to decide the suit at an early date. The record of the case shall be transferred to the transferee Court, within three weeks. 7. Registry shall communicate this order to both the Courts, electronically by 17.06.2025.
