Neutral Citation No. - 2025:AHC-LKO:26683 Court No. - 8 Case :- CIVIL REVISION No. - 104 of 2007 Revisionist :- Mahant Janardan Das Chela Late Mahant Ram Bachan Das Opposite Party :- Mahant Sia Ram Das Alleged Chela Of Mahant Ayodhia Das Counsel for Revisionist :- S.K.Srivastava,Appoli Srivastava,Sujata Srivastava Counsel for Opposite Party :- Umesh Chandra Pandey,Narsingh Narain Lal & Case :- CIVIL REVISION No. - 103 of 2007 Revisionist :- Mahant Janardan Das Chela Late Mahant Ram Bachan Das Opposite Party :- Mahant Sia Ram Das Alleged Chela Of Mahant Ayodhia Das Counsel for Revisionist :- S.K.Srivastava,Appoli Srivastava,Sujata Srivastava Counsel for Opposite Party :- Umesh Chandra Pandey Hon'ble Jaspreet Singh,J.
1. None appears for the revisionists. 2. In both the connected revisions, despite name of Shri S.K.Srivastava, Appoli Srivastava and Sujata Srivastava have been printed as counsel for the revisionists. 3. Learned counsel for the respondent in the above civil revisions namely Shri Umesh Chandra Pandey has informed the court that the instant two civil revisions are directed against the order passed by the Reference Court wherein the dispute under Section 50 of the Land Acquisition Act was under consideration. 4. During the pendency of the proceedings before the Reference Court, some of the parties have died wherein an application for substitution was moved which was allowed by the reference court. That order allowing the application for substitution was called in question in the instant two revisions but at no point of time there was any interim order subsisted in the aforesaid revisions. 5. It has also been pointed out that earlier the revisions were dismissed for want of prosecution on 9.12.2017 whereafter on an application moved by the revisionists, the order was recalled and the revisions were restored in the month of November,
2023. However, since there was no interim order, accordingly the reference court has decided the matter under Section 30 of the Land Acquisition Act finally by means of the order dated 8.10.2024 and thus it is stated that nothing survives in the instant civil revisions as the order against which the revisions were filed, the original proceedings itself had been decided. 6. Considering the aforesaid and noticing that there is none on behalf of the revisionists, the revisions are accordingly dismissed.
