Neutral Citation No. - 2025:AHC-LKO:8837 Court No. - 15 Case :- CRIMINAL MISC ANTICIPATORY BAIL APPLICATION U/S 438 CR.P.C. No. - 164 of 2025 Applicant :- Umesh Kumar Opposite Party :- State Of U.P. Thru. Prin. Secy. Home U.P. Lko. Counsel for Applicant :- Deepak Kumar,Alok Kumar Counsel for Opposite Party :- G.A. Hon'ble Shree Prakash Singh,J. Heard learned counsel for the applicant, learned AGA for the State and perused the record. The instant application has been filed on behalf of the applicant with the prayer to release him on anticipatory bail in Case Crime No. 284 of 2023, under Sections 419, 420, 465, 467, 468, 471 and 120B IPC and Section 4/10 of The Uttar Pradesh Public Examination (Prevention of Unfair Means) Act, 1998, Police Station Mandion, District Lucknow. From perusal of the First Information Report and after hearing the arguments of learned counsel for the parties, it transpires that the applicant, prima facie, seems to be involved in committing the offence. Further, the applicant, prima facie, seems to be a member of a solver gang. Further, on the basis of instructions, it has been stated by learned Counsel for the State that some amount is incredited in the account of co-accused from the account of the applicant which connects the story, as such, this Court do not find any good ground to intervene in the matter.
Learned counsel for the applicant has also failed to satisfactorily substantiate that the applicant would not tamper the evidences and would not threaten the witnesses and the apprehension of arrest has also been denied. The instant anticipatory bail application is, accordingly, dismissed.
