Heard the learned counsel for the petitioners and the learned Assistant Public Prosecutor appearing for the State. 2. The petitioners were arraigned as A.2 to A.5 in Crime No.79 of 2024 of Cumbum Police Station, Prakasam District, registered for the alleged offence under Sections 376, 417, 506, 509 read with 34 of the Indian Penal Code, 1860. 3. The learned counsel for the petitioners submits that 1st petitioner is the mother, the 2nd petitioner is the sister, and the 4th petitioner is the maternal uncle of A.1. The 3rd petitioner is the husband of the 2nd petitioner. The learned counsel further submits that even as per the complaint, there are no allegations against the petitioners and hence, the petitioners cannot be charged with an offence under Section 376 of the I.P.C. 4. Considering the same, this Court is inclined to dispose off the criminal petition, by directing the Station House Officer, Cumbum Police Station, Prakasam District, to follow the procedure as contemplated under Section 35 (3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, insofar as the petitioners/A.2 to A.5 are concerned, for the purpose of investigation in connection with Crime No.79 of 2025. -3- 5.
