The instant application was filed seeking to quash the summoning order dated 17.05.2012 passed by the Additional Chief Judicial Magistrate-IInd Ballia as well as the entire criminal proceedings of Criminal Complaint Case No. 656 of 2011 under Sections 323, 498A I.P.C., and Section 3/4 D.P. Act, Police Station Rasada, District Ballia. Vide order dated 05.10.2012, the matter was referred to the Mediation Centre subject to deposit a sum of Rs. 15,000/- as per the report received from the Mediation Centre dated 29.11.2012. The applicants have failed to deposit the said amount. In view thereof, it is apparent that the applicants have got referred the matter for Mediation Centre only for the purpose of obtaining an interim order without there being any intent on the part of the applicants to settle the matter through Mediation Centre and today also none is present on behalf of the applicants to press the instant application. In view thereof, the instant application is dismissed for non compliance of the earlier order. Registrar (Compliance) is directed to communicate this order to the trial Court concerned.
