And 3 Others Counsel for Petitioner :- Onkar Nath Tiwari Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy,J. Hon'ble Brij Raj Singh,J. Heard. This petition has been filed by the petitioner seeking the following reliefs:-
"(I) a writ, order or direction in the nature of Mandamus commanding and directing the opposite parties not to compel the petitioner to transfer recorded Bhumidhari land of the petitioner i.e. plot no. 125 situated in Village - Oharpur, Nagar Panchayat Bikapur, District Ayodhya in favour of the respondents for construction of 'N.H. 227B (84 Koshi Parikrama Marg) without publishing revise District Magistrate circle rate of District Ayodhya and without evaluating trees, Tube well etc. as per District Magistrate circle rate in the end of justice. (II) a writ, order or direction in the nature of mandamus commanding and directing the opposite parties to publish the final revise D.M. circle rate of 2024- 25 District Ayodhya and make assessment of the valuation of land of the petitioner as per Abadi site." The land of the petitioner has been acquired, but from the relief clause it is being conveyed, as if, the opposite parties want to purchase the land from the petitioner, that is why the words 'transfer' has been used. Learned Standing Counsel says that the award has already been declared on 30.08.2024. We fail to understand as to how in these circumstances, a writ petition under Article 226 of the Constitution of India is maintainable with the relief prayed. The writ petition is accordingly dismissed.
