In pursuance of query posed vide order dated 28.01.2025, learned counsel for applicant submits that a second application under Section 24 of Code of Civil Procedure is not maintainable in view of judgment rendered by Hon'ble this Court in Transfer Application (Civil) No.121 of 2021 (Babu Singh & Ors versus Raj Bahadur Singh & Ors.). In view thereof, he seeks to withdraw this transfer application in order to available himself of appropriate remedy. Considering aforesaid submissions, the transfer application is dismissed as withdrawn granting liberty to applicant to avail himself of the appropriate legal remedy.
