Respondent No.1 has filed counter-affidavit stating that in pursuance of the orders passed by this Court based on the enquiry report submitted by the Deputy Educational Officer, Nandyal, the Regional Joint Director of School Education, Kadapa vide Rc.No.2916/B3/2023, dated 09.10.2023 issued show cause notice to the management of Saint Josephs Girls High School, Nandyal District, to submit the explanation within 7 days. 3. On receipt of the explanation on 23.02.2024, the Regional Joint Director of School Education, Kadapa, duly considered the said explanation based on the report submitted by the respondents on 07.9.2023 & 27.02.2024 and has come to a conclusion that the allegations leveled against their management are proved and the management has been collecting huge fees and contravened the rules under AP Education Act, 1982 read with G.O.Ms.No.1, Education Department, dated 01.01.1994. Accordingly, proceedings were issued vide Rc.No.2916/B2/2023, dated 20.3.2024 by imposing penalty of 3 VS,J M.A.C.M.A.No.9 of 2019 Rs.2,00,000/- (Rupees Two Lakhs Only) as against the management as per the provisions under Section 21(2)(f) of the Andhra Pradesh Education Act, 1982 and separate proceedings were also issued by the respondent No.2 to the concerned management directing them to return the collected fee to the ward of the petitioner vide Rc.No.2916/B2/2023-1, dated 20.3.2024 and in pursuance of the said proceedings, the management has also paid the penalty of Rs.2,00,000/- (Rupees Two Lakhs Only) by way of DD bearing No.528765, dated 28.5.2024 and in support of the same, the respondent No.1 has also filed the relevant documents. 4. In view of the above, as action has already been initiated by the Regional Joint Director- Respondent No.2 against the management of the Saint Joseph Girls High School, Nandyal, pursuant to the orders of this Court passed in the Writ Petition, this Court is inclined to close the Contempt Case. 5. Accordingly, the Contempt Case is closed. There shall be no order as to costs.
