The petitioner has been made accused in connection with Chandwa P.S. Case No. 85 of 2023 corresponding to N.D.P.S. Case No. 01/2024, for the offences registered under sections 15(c), 16 and 18(b) of NDPS Act, pending in the court of learned Special Judge-cum-Sessions Judge, Latehar. 3. The bail application of the petitioner was earlier rejected by this Court in B.A. No. 1435/2024 vide order dated 03.04.2024. 4. On 08.04.2023 at about 12.00 noon, Chandwa Police on the basis of confidential information, intercepted a truck bearing registration no. RJ 07GC 1255 and seized 4.5 tonnes of poppy husks loaded on it. 5. The quantum of recovered contraband comes within the purview of commercial quantity. 6. Report regarding the stage of trial earlier called for, has been received. It appears that out of 13 witnesses, 4 witnesses have been examined. Learned Trial Court has stated that the trial is likely to be concluded within five months. 7. Considering the aforesaid facts, I am not inclined to release the petitioner, on bail. Accordingly, his prayer for bail stands rejected at this stage. 8. The petitioner, if so advised, may renew his prayer for bail after five months if the trial is not concluded within the stipulated period. (Ambuj Nath, J.) Rahul/-
