Neutral Citation No. - 2025:AHC-LKO:6084-DB Court No. - 2 Case :- WRIT - C No. - 881 of 2025 Petitioner :- Mohd.Shad Khan Respondent :- State Of U.P. Thru. Prin. Secy. Home Deptt. Civil Secy. Lko. And 4 Others Counsel for Petitioner :- Sidhant Rathour,Utkarsh Mishra,Yash Gautam Counsel for Respondent :- C.S.C.,Prashant Kumar Srivastava Hon'ble Rajan Roy,J. Hon'ble Brij Raj Singh,J. Vakalatnama filed by Shri Arjun Krishna, Advocate, Shri Manu Dixit, Advocate and Shri Arpit Gupta, Advocate on behalf of the opposite party no. 4 is taken on record. Heard. The petitioner alleges fraudulent withdrawal of certain money from his account. An F.I.R. has already been lodged. Now, the petitioner wants a direction in the nature of Mandamus to the Reserve Bank of India to expeditiously recover the said money of the petitioner, as early as possible by way of relief number 1. The second relief is also of similar nature, but here a Mandamus has been sought to opposite parties no. 2 to 4 i.e. including two other Banks, HDFC Bank and Bank of Baroda. At this stage, learned Counsel for the petitioner says that he had approached the Ombudsman who had rejected the claim on the ground that the petitioner had shared the O.T.P. (One Time Password) which according to him is factually incorrect. Any such decision of the Ombudsman is not under challenge before us. The petitioner may pursue other remedies as may be prescribed in law. We cannot go into such questions, especially as, the petitioner has not been able to show as to under which provision of law, the Reserve Bank of India could recover such money and give it to the petitioner. The writ petition is accordingly disposed of.
