Hon'ble Rajeev Singh,J. 1. Heard learned counsel for petitioners and the learned A.G.A. for State. 2. In pursuance of the earlier order dated 28.01.2025, detenue/petitioner no.1 (Smt. Shivani Singh) is present before this Court and stated that she was being victimized by her husband/the deponent of the present case. As a result, she is residing at her parents house along with her children Himanshu Singh and Master Ashutosh Singh (petitioners 2 and 3). She further stated that she is still willing to join the company of the deponent in case he is ready to treat her and her children in proper manner. 3. Pursuant to earlier order dated 28.01.2025, a Demand Draft bearing No.000760 dated 30.01.2025, drawn on Axis Bank, Felix Square Branch, Lucknow amounting to Rs.25,000/- is produced before this Court, the photocopy of the same is taken on record. The original Demand Draft has been handed over to detenue/petitioner no.1 (Smt. Shivani Singh). 4. Since the detenue/petitioner no.1 (Smt. Shivani Singh) has categorically stated before this Court that she is residing at her parents house along with their children, this Court is of the view that present habeas corpus petition is not maintainable and is liable to be dismissed. 5. It is accordingly dismissed. 6. Sri Rakesh Kumar Singh, Sub-Inspector of police station Sahjanwa, district Gorakhpur is present before this Court. His present is exempted. Order Date :- 27.2.2025.
