Neutral Citation No. - 2025:AHC-LKO:8095 Court No. - 15 Case :- CRIMINAL MISC ANTICIPATORY BAIL APPLICATION U/S 438 CR.P.C. No. - 151 of 2025 Applicant :- Mithlesh Yadav Opposite Party :- State Of U.P. Thru. Prin. Secy. Home Deptt. Lko. Thru. S.H.O. And Another Counsel for Applicant :- Eshan Garg,Prachi Arya Counsel for Opposite Party :- G.A. Hon'ble Shree Prakash Singh,J. Heard learned counsel for the applicant, learned AGA for the State and perused the record. The instant anticipatory bail application has been filed on behalf of the applicant with the prayer to release him on anticipatory bail in Case Crime No. 160 of 2021, under sections 406,420 of the I.P.C., Police Station-Ramkot, District-Sitapur. A preliminary objection is raised by the learned counsel for the State that the applicant has approached this court directly while filing the instant anticipatory bail application and as such, the same is not maintainable. On the other hand, learned counsel appearing for the applicant has vehemently opposed the
contentions aforesaid and submits that there are sufÏcient reasons to directly approach this court while filing the anticipatory bail application as the applicant is a woman and there is an acute apprehension of her arrest. Considering the submissions of learned counsel for the parties and from perusal of memo of this anticipatory bail application, it transpires that the reasons for directly approaching this court, are not mentioned and the facts, which are mentioned in paragraph nos. 14 & 16 of the bail application, are not sufÏcient to entertain this anticipatory bail application. In this view of the matter, the present anticipatory bail application is not maintainable and it is hereby dismissed with liberty to the applicant to approach the trial court concerned.
