4. Petitioner is serving as Paryavaran Mitra in Nagar Nigam Haldwani. He was placed under suspension by the Municipal Commissioner, vide
order dated 01.08.2025 because of his detention by the police for offence punishable under Narcotic Drugs and Psychotropic Substances Act, 1985.
5. It is the case of petitioner that he has been enlarged on bail by coordinate Bench, vide order dated 17.09.2025. In this writ petition, petitioner has challenged the suspension order passed by Municipal Commissioner, Nagar Nigam Haldwani.
6. Since Rule 4(3)(b) of Uttarakhand Government Servants (Discipline and Appeal) Rules, 2003 entitles an employee to make representation against his deemed suspension, therefore, the writ petition is disposed of with liberty to petitioner to make representation before the Competent Authority against his suspension. If such representation is made within ten days from today, decision thereupon shall be taken within four weeks thereafter.
