Heard learned counsel for the appellant, learned AGA for the State of U.P. and perused the record. The present appeal under Section 14(1) of Scheduled Cases and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (in short "SC/ST Act") has been filed against the order dated 06.08.2019 passed by the Special Judge (SC/ST) Act, Pratapgarh in Special Trial No. 443/2015 arising out of Case Crime No. 152/2006, under Sections 323, 504, 506 I.P.C. and Section 3(1)(X) of S.C./S.T. Act, Police Station Mandhata, District Pratapgarh, whereby, Non-Bailable Warrant has been issued against the appellant. Considering the facts, as stated, that the appellant was on bail and on account of non-appearance of his counsel and the appellant as well, the impugned order dated 06.08.2019 has been passed and the punishment in all the Sections is upto seven years, it is provided that the appellant shall move an appropriate application before the trial court including for recall of non-bailable warrant within a period of two weeks from today. In case, such an application is moved in terms of this order, then, the same shall be considered and decided by the trial court expeditiously strictly in accordance with law. For a period of two weeks, the order dated 06.08.2019, whereby, Non-Bailable Warrant has been issued against the appellant, shall be kept in abeyance.
