Neutral Citation No. - 2025:AHC-LKO:7702-DB Court No. - 2 Case :- WRIT - C No. - 847 of 2025 Petitioner :- Shruti Singh Respondent :- State Of U.P. Thru. Its Prin. Secy. Deptt. Of Revenue Lko. And 6 Others Counsel for Petitioner :- Manuvendra Singh Counsel for Respondent :- C.S.C.,Mohan Singh Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J.
1. Heard Shri Manuvendra Singh, learned counsel for the petitioner, learned Additional Chief Standing Counsel for the State and Shri Mohan Singh, learned counsel for the Gaon Sabha.
2. The petitioner is aggrieved by non determination of her share in the holdings.
3. If she has a right and interest therein, then, she can initiate proceedings under the U.P. Revenue Code, 2006 or such other statutory provision as may be prescribed in law, but, we see no reason to consider and issue a general direction for any inquiry. If the judgment of the High Court has been violated the concerned can initiate proceedings in this regard.
4. At this stage, learned counsel for the petitioner says that the land is not agricultural land rather it falls in the purview of Zila Panchayat and is a commercial land.
5. If it is so, then, we fail to understand as to how any share can be determined in the Khatauni, at least, the learned counsel could not satisfy us on this count, therefore, she may seek such other remedies as may be prescribed in law.
6. With the aforesaid observations, the writ petition is disposed of. . (Om Prakash Shukla,J.) (Rajan Roy,J.) Order Date :- 6.2.2025 R.K.P. Digitally signed by :- RAJ KUMAR PATEL High Court of Judicature at Allahabad, Lucknow Bench
