A case has been registered against the petitioner for the offence punishable under Sections 457 & 380 IPC. 3. The brief facts of the case are that on the intervening night of 25/26.02.2024 at GRO No.12189, Ramireddymotu, Jammalamadugu town, some unknown offenders cut the iron sheet roof top of the GRO No.12189, entered into the shop through roof, broken the iron chest in the shop and committed theft of Rs.8,04,680/- which is the three days collection amount of Government liquor shop and decamped with booty. Based on the complainant given by one Jitta Venkatesh, Supervisor of the said shop, the present crime was registered on 26.02.2024. During the course of investigation, the petitioner was arrested on 10.02.2025 and remanded to judicial custody and the remaining accused are yet to be arrested. 4. Heard learned counsel for the petitioner and the learned Assistant Public Prosecutor representing the respondent/State. Perused the record. 5. Learned counsel for the petitioner/accused contends that the petitioner was arrested on 10.02.2025 and since then he has been in judicial custody, and the petitioner was arrested only due to the pending previous cases against him. 3 6. Learned Assistant Public Prosecutor opposed to grant bail to the petitioner on the ground that investigation is not yet completed, and according to her instructions, petitioner is a habitual offender and eight similar cases have been registered against him. 7. After careful observation of the material on record and submissions made on behalf of both sides, it appears that there is a force in the arguments put forth by the learned Assistant Public Prosecutor that material part of investigation is still pending and two more accused are yet to be apprehended. Considering the submission that the petitioner is a habitual offender, this Court is not inclined to grant bail to the petitioner/A.1 at this stage. 8. In the result, the Criminal Petition is dismissed.
