learned counsel, appears for the applicant. [2]
The present miscellaneous application has been filed on behalf of the applicant for condoning the delay of 30 days in preferring the accompanying Criminal Appeal challenging the impugned order dated 30.11.2023 passed by the Spl. Judge (NIA), Manipur in Cril. Misc. (B) Case No. 108 of 2023 in Spl. T (NIA) Case No. 1 of 2023 arising out of RC-02 of 2022-NIA-IMP. [3]
We have gone through the reasons given in the application and we are also satisfied with the reasons given by the applicant for condoning the delay of 30 days in preferring the accompanying Criminal Appeal. [4]
The application has been filed before the Special Court, NIA for cancellation of the bail on the ground that the respondent was absconded and SHAMURAILATPAM SUSHIL SHARMA Digitally signed by SHAMURAILATPAM SUSHIL SHARMA Date: 2025.04.22 12:51:41 +05'30'

warrant of arrest was also issued to the respondent/accused by the Special Court, NIA on 25.09.2024 and considering the aforesaid submission, the appellant is not in a position to serve the notice to the respondent. Therefore, he seeks disposal of the Appeal on the same terms. [5]
Considering the above, the miscellaneous application is disposed and the delay of 30 days in filing the Criminal Appeal is condoned. [6]
Registry is directed to number the criminal appeal if it is otherwise in
order and list the same for admission.
