[2025:JHHC:14966] IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No.3934 of 2025 ------ Anish Ekka, aged about 40 years S/o. Late Barnabas Ekka, resident of village Jaipur, P.O.- Jamgai, P.O.- Chainpur, Gumla, Jharkhand. .... .... …. Petitioner Versus The State of Jharkhand .... .... .... Opposite Party ------ CORAM : HON'BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioner : Mrs. Sugandha Khalkho, Advocate For the State : Mr. Saket Kumar, Addl.P.P ------ Order No.02 Dated-10-06-2025 Heard the parties. The petitioner has been made accused in connection with Chainpur P.S. Case No.43 of 2024 corresponding to G.R. Case No.42 of 2025 registered for the offence punishable under Section 103(1) of the B.N.S., 2023. Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner has committed murder of his own wife under the influence of liquor. It is next submitted that the allegation against the petitioner is false. It is then submitted that the petitioner has been in custody since 14.10.2024 as is evident from para-6 of the instant bail application. It is also submitted that the petitioner has no criminal antecedent as mentioned in para-12 of the instant bail application. It is then submitted that the petitioner has no intention to kill anybody. It is also submitted that the petitioner has six minor children and there is no one to look after them. Hence, it is submitted that the petitioner be released on bail. Learned Addl.P.P. appearing for the State opposes the prayer for bail of the petitioner and submits that the petitioner is a threat to his own children as he has killed his own wife, under the influence of liquor. So, there is every chance of the petitioner killing to his own minor children and there is also every chance of the petitioner absconding, if released on bail. Hence, it is submitted that the petitioner ought not to be released on bail. Considering the serious nature of allegation against the petitioner as well as his chance of absconding, if released on bail, this Court is not inclined to admit the bail of the above named petitioner. Accordingly, at this stage, the prayer for bail of the above named petitioner is rejected. (Anil Kumar Choudhary, J.) Saroj/
