The present Application has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for quashing the entire proceedings of Criminal Case No.108 of 2023, “State of Uttarakhand Vs. Monu Shukla alias Ashish and Another”, on the ground of compounding the offences. The said case is pending before the court of Judicial Magistrate, Kiccha, District 1 2025:UHC:8994 Udham Singh Nagar under Sections 323, 341, 427 and Section 506 of the Indian Penal Code, 1860. 2. Mr. Mani Kumar, learned counsel for the applicants-accused, Mr. Pratiroop Pandey, learned Assistant Government Advocate for the respondent no.1 and Mr. Manoj Bhatt, learned counsel for the respondent no.2-informant and the respondent no.3- injured. 3. Both the applicants and the respondent nos.2 and 3 are present through video conferencing. Applicants are identified by Mr. Mani Kumar, Advocate. The respondent no.2 and the respondent no.3 are identified by Mr. Manoj Bhatt, Advocate. 4. The respondent no.2 and the respondent no.3 submitted that they have compounded the offences with their free will and without any pressure. They have filed a joint Compounding Application (IA No.01 of 2025) and affidavits. 5. The respondent nos.2 and 3 has requested to quash the entire proceedings of the said Criminal Case No.108 of 2023. 6. The said request of the respondent nos.2 and 3 has not been opposed by the respondent no.1. 2 2025:UHC:8994 7. Considering the totality of the matter, this Court is of the view that ends of justice would be met if the entire proceedings of Criminal Case No.108 of 2023, “State of Uttarakhand Vs. Monu Shukla alias Ashish and Another”, are quashed. 8. Resultantly, the present Application, filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is allowed and the entire proceedings of Criminal Case No.108 of 2023, “State of Uttarakhand Vs. Monu Shukla alias Ashish and Another”, are hereby quashed in view of the statement made by the applicants and the respondent nos.2 and 3 that the matter has been amiably settled between them. ___________________ ALOK KUMAR VERMA, J.
