JUSTICE VINOD KUMAR BHARWANI Order 19/05/2025 The writ petition has been filed by the petitioners under Article 227 of the Constitution of India against the order dated 27.01.2025 passed by Senior Civil Judge No.1, Kaman, District Bharatpur (Raj.), in Civil Misc. No.66/2024, whereby the application filed by the petitioners for appointment of "Mauka Commissioner", was dismissed. Learned counsel for the petitioners submits that looking to the dispute between the parties, it is necessary in the matter to obtain report of "Mauka Commissioner" after inspection of the disputed property. Therefore, the learned Trial Court has committed grave error in dismissing the application. [2025:RJ-JP:20925] (2 of 2) [CW-6210/2025] Heard learned counsel for the petitioners and perused the order of learned Trial Court dated 27.01.2025, the pleadings mentioned in Para No.3 of the plaint & the relief sought by the plaintiff. The Learned Trial Court, after considering all the facts, has passed a reasoned order, which is just & proper. No illegality, infirmity or error has been committed by the learned Trial Court in the aforesaid order. Hence, there is no scope for interference in the aforesaid order under the limited writ jurisdiction under Article 227 of the Constitution of India.
