At the outset, an objection has been raised by the learned Standing Counsel that the order which has been impugned, has been passed in exercise of powers under Section 80 of U.P. Revenue Code, 2006 (hereinafter referred to as "Code of 2006") against which the petitioner has statutory remedy under the ode of 2006 itself. Learned counsel for the petitioner after arguing at some length, states that he may be permitted to withdraw the petition with liberty to assail the order before the appropriate forum under the Code of 2006. Accordingly, the petition is dismissed as withdrawn with the aforesaid liberty.
