order dated 21.02.2025 passed by learned Special Judge, Session Court, Anti Corruption and Prevention Act, 1988 in connection with FIR No.30/2025, registered at Police Station C.P.S. Jaipur, District Anti Corruption Bureau for the offence punishable under Section 7 of Prevention of Corruption 1988 (Amendment) Act, 2018, by which the bail application of the accused-applicant under Section 483 of the B.N.S.S, 2023 has been dismissed.
2.
Learned counsel for the accused-applicant submits that the accused-applicant has falsely been implicated in this matter.
Learned counsel argues that the accused-applicant is aged about
[2025:RJ-JP:18155] (2 of 3) [CRLMB-3936/2025] 59 years and holding the post of Patwari. Learned counsel also argues that charge levelled against the accused-applicant is that he received Rs.4,000/- from the complainant. Learned counsel contends that the accused-applicant was arrested on 12.02.2025 and since then, he is behind the bars. Learned counsel further contends that the accused-applicant is a heart patient. Learned counsel prays that charge-sheet has been filed and trial will take long time to conclude, therefore, the accused-applicant be enlarged on bail.
3. On the other other hand, learned Public Prosecutor while submitting the factual report dated 28.04.2025, opposes the bail application.
4. Factual report dated 28.04.2025 is taken on record.
5. Heard learned counsel for the parties and also perused the material available on record.
6. Having regard to the facts and circumstances of the case and considering the submissions made on behalf of the parties and also considering the fact that charge-sheet has been filed and trial will take long time to conclude as well as considering the fact that the accused-applicant is 59 years of age, but without expressing any opinion on the merits/demerits of the case, this Court deems it proper to allow the bail application filed by the accused- applicant.
7. Consequently, this bail application filed under Section 483 of the B.N.S.S, 2023 is allowed. It is ordered that accused-applicant Ramnivas S/o Late Cheetarlal, arrested in FIR No. 30/2025, registered at Police Station C.P.S. The Accused-Applicant shall be required to appear before that Court on all dates of hearing and as and when called upon to do so.
