Hon'ble Abdul Moin,J. Heard learned counsel for the petitioner, Shri Atul Dwivedi,
learned counsel for the respondents no. 1 & 2 and learned Standing Counsel for the respondent no. 3. With the consent of learned counsels appearing for the contesting parties, the writ petition is finally being decided
Learned counsel for the parties contend that the issue involved in WRIT - A No. - 1264 of 2025 and WRIT - A No. - 1289 of 2025 are the same. As such, the Court proceeds to hear both the writ petitions together. For convenience, facts of Writ A No. 1264 of 2025 are being taken. Although Under challenge is the order dated 20.11.2024, a copy of which is annexure 13 to the writ petition, whereby the claim of the petitioner for ad-hoc promotion has been rejected,
learned counsel for the petitioner informs that while the petitioner was working as Office Assistant his claim for promotion to the post of Senior Office Assistant was considered and kept in sealed cover. The sealed cover procedure was adopted on account of pendency of Case Crime No. 228 of
2013 however subsequent thereto the petitioner has been acquitted in the said criminal case vide judgement and order dated 27.06.2025 and consequently there is on occasion for the respondents to continue with the sealed cover with regard to the petitioner. In the connected writ petition, the consideration pertains to post of Accountant. The aforesaid is also agreed to by learned counsels for the respondents. Considering the aforesaid, the writ petition is disposed of with a direction to the competent authority to open the sealed cover as adopted by the respondents in case there is no other legal impediment and to act upon the same accordingly. Let the sealed cover be opened within a period of three weeks from the date of receipt of a certified copy of this order. As the order impugned only rejects the claim for ad-hoc promotion and now the sealed cover is to be opened, consequently there cannot by any occasion for interfering with the order impugned.
