1. The petitioner by way of this petition seeks quashing of the notice dated 25.05.2007, by which the land of the petitioner measuring 6 kanals 13 marlas under lying Khasra No. 25 has been categorized as commercial under Roshni Act, and the market value of the same has been assessed @ Rs. 3 lakh per kanal.
2. The Jammu and Kashmir State Lands (Vesting of Ownership to the Occupants) Act, 2001 has been declared as unconstitutional by the Division Bench of this Court vide judgment dated 09.10.2020 rendered in PIL No. 19/2011 titled “Prof. S. K. Bhalla & others Vs. State of J&K and others”. In view of the said judgment, this petition has become infructuous.
3. In view of the aforesaid, this petition does not survive for consideration and is, accordingly, dismissed. However, petitioner is at liberty to avail appropriate remedy available under law.
