Neutral Citation No. - 2025:AHC-LKO:6395 Court No. - 7 Case :- WRIT - C No. - 844 of 2025 Petitioner :- Najrin Bano Respondent :- State Of U.P. Thru. Prin. Secy. Food And Civil Supplies Lko And 7 Others Counsel for Petitioner :- Dinesh Kumar Ojha Counsel for Respondent :- C.S.C.,Pankaj Gupta Hon'ble Pankaj Bhatia,J.
1. Heard the counsel for the petitioner, Sri Padam Kant Mishra who appears for the respondent no.8 and the learned Standing Counsel.
2. The present petition has been filed by the petitioner challenging the order dated 17.01.2025, whereby the shop in question was allotted to the respondent no.8.
3. The contention of the counsel for the petitioner is that the manner of calling the meeting was contrary to the Government
Order. It is further argued that the petitioner had earlier approached this court by filing a petition Writ-C No.239 of 2025 wherein directions were issued to decide the objection prior to finalizing the allotment vide order dated 20.01.2025. It is argued that the prior to the order being served, the order dated 17.01.2025 had already been passed.
4. While arguing this petition, the main submission is that a meeting was called at a very short notice and was held in the absence of the Gram Pradhan. The facts reveal that along with the respondent no.8, the petitioner had also participated and she secured 37 votes, whereas the respondent no.8 secured 727 votes.
5. Once the petitioner had already participated, she is estopped from raising legality of the meeting, having failed miserably and further there being no pleading to the effect that the petitioner was not present in the meeting, no relief as sought can be granted at the behest of an unsuccessful candidate.
6. The writ petition is dismissed.
