Neutral Citation No. - 2025:AHC-LKO:6348-DB Court No. - 1 Case :- PUBLIC INTEREST LITIGATION (PIL) No. - 83 of 2025 Petitioner :- Desh Deepak Respondent :- Distt. Magistrate Distt. Sultanpur And 2 Others Counsel for Petitioner :- Ashish Kumar Shukla,Ram Pratap Yadav Counsel for Respondent :- C.S.C. Hon'ble Attau Rahman Masoodi,J. Hon'ble Subhash Vidyarthi,J.
1. Heard the learned counsel for the petitioner, the learned Standing Counsel appearing on behalf of the State and Sri Satyendra Nath Mishra, Advocate who has put in appearance on behalf of the opposite party no.3 and filed his vakalatnama, which is taken on record.
2. It appears that the subject matter of the instant writ petition is already under consideration before the Executive Authorities on the basis of a representation made by the petitioner. Once the petitioner has approached the Executive Authorities who have taken action on the said representation, we do not deem it proper to entertain the present writ petition while the administrative action is in progress.
3. Moreover, the petitioner seems to be residing in the neighborhood of opposite party no.3. The personal grudge or otherwise can also not be deciphered by this court in the circumstances of the case, which is evident from the particulars of address of the petitioner viz-a-viz the opposite party no.3.
4. The writ petition being bereft of merit is dismissed. [Subhash Vidyarthi, J.] [A.R. Masoodi, J.] Order Date :- 30.1.2025 Ram. Digitally signed by :- RAM SINGH High Court of Judicature at Allahabad, Lucknow Bench
