Notice on behalf of the respondents No.1 and 2 has been accepted by the office of the Chief Standing Counsel. In view of the order proposed to be passed by this Court, notice to the private-respondent is dispensed with. By means of the instant petition, the petitioner has prayed with limited prayer that the petitioner has preferred a revision, which is pending before the Board of Revenue, however, the revision has not been decided for admission nor the application for interim relief has been considered, as a result, the petitioner is suffering undue hardship. Considering the facts and circumstances, this Court is of the opinion that no gainful purpose will be served in keeping the aforesaid petition, accordingly, the petition is disposed of with direction to the respondent No.2 to consider and decide the pending revision of the petitioner for admission as well as the application for interim relief after affording an opportunity of hearing to the parties, appropriate orders be passed. It is made clear that the Court has not examined the case of either of the parties on merits and the Court concerned shall consider and decide the case of the petitioner strictly in accordance with law.
