Heard, This is first bail application before this Court filed by the applicant for grant of regular bail. The applicant has been arrested on 14/02/2025 in connection with Crime No. 299/2024 registered at P.S. Suhela, Dist- Balodabazar- Bhatapara (CG) for the offence under Section 376 (2)(n) of B.N.S. and Section 06 of POCSO Act. 2 2. Pursuant to the order dated 28.03.2025, the victim along with her father appeared through virtual mode from DLSA- Balodabazar and raised objection in granting bail to the applicant. Their submission is taken on record. 3. The case of the prosecution is that on 30/11/2024, the FIR has been lodged against the applicant alleging in it that the victim who is a minor girl aged about 16 years was sexually exploited by the applicant since 02.11.2023 to 15.04.2024. When the victim conceived pregnancy, the applicant thrown her out from his house and when she was roaming near Raipur Railway Station, she was seen by the members of Self Help Group who took her to GRP, Police Station, Raipur from where she was sent for Pratigya Vikash Sansthan, Open Shelter Home, Raipur. On the report made by the teacher of Pratigya Vikash Sansthan the FIR for the offence under Section 376 (2)(n) of IPC and Section 06 of POCSO Act has been registered on 22.11.2024. The applicant has been arrested on 02/12/2024, and after investigation charge-sheet has been filed. 4. Learned counsel for the applicant would submit that the victim is a major girl, having love affair with the applicant and she herself eloped with the applicant and engaged in making consensual physical relation and she has not made any complaint to anyone when she was residing with the applicant. Some dispute arose between them and she left his house and then she was being found by the GRP, Police Raipur at Raipur Railway Station from where she was sent to Pratigya Vikash Sansthan, Open Shelter Home. The investigation has been completed and the applicant is in jail since 02.12.2024 and final adjudication of the case will take its own time, therefore, he may be enlarged on bail. 3 5. On the other hand, learned counsel for the State opposes and has submitted that the victim who is a minor girl having sexually exploited by the applicant by which she conceived pregnancy and ultimately delivered a child. The applicant has performed marriage with another girl and left the victim along with her child. Looking to the age of the and the act of the applicant, he is not entitled for bail. 6. I have heard learned counsel for the parties and perused the material annexed with the petition. 7. Considering the submissions made by learned counsel for the parties, considering the nature of allegation and the material collected during the investigation, further considering the age of the victim as well as her 183 B.N.S.S. 2023 statement and also the fact that she was being sexually exploited and delivered a child from the applicant, I am not inclined to release the applicant on bail. 8. Consequently, the application filed by the applicant for grant of regular bail is hereby rejected.
