Applicant Gaurav Kumar is in judicial custody in Case Crime No. 520 of 2019, under Sections 302, 394, 411 IPC, Police Station Kashipur, District Udham Singh Nagar. He has sought his release on bail.

This is third bail application of the applicant. The first bail application and the second bail application of the applicant have already been rejected on 15.06.2022 and 20.09.2023, respectively.

Heard learned counsel for the parties and perused the record.

Learned counsel for the applicant submits that the applicant is in judicial custody since 25.10.2019; out of 40 prosecution witnesses, only 6 witnesses have been examined. Learned counsel submits that there are less chances of completion of trial in near future.

Learned State Counsel admits these facts.

Having considered the period of incarceration, which the applicant has undergone, and other attending factors, this Court is of
2 the view that it is a case fit for bail and the applicant deserves to be enlarged on bail.

The bail application is allowed.

Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned.
