(2) This writ petition has been filed by Uttarakhand Diploma Engineers Sangh (Payjal Nigam, Uttarakhand Peyjal Sansadhan Vikas Evam Nirman Nigam) seeking the following reliefs: “I. Issue a writ, order or direction in the nature of mandamus commanding respondent no. 1 to make provision of funds on regular basis to reimburse the difference for payment of regular monthly salary and other allowances of the employees of respondent no. 2/member of petitioner within the first week of the following month in pursuance of circular dated 30.03.2016 (Annexure No. 01). II. Issue a writ, order or direction in the nature of mandamus commanding respondent no. 1 that in case the funds are not provided for payment of monthly salary of the members of the petitioner/employees of respondent no. 2 within first week of the following month the members of the petitioner/employees of respondent no. 2 will be entitled for interest @ 10% per annum.” (3) Learned State Counsel is right in submitting that writ petition is thoroughly misconceived as there cannot be any direction to State Government to provide funds to a statutory body on regular basis. It is not in dispute that Uttarakhand Peyjal Sansadhan Vikas 2025:UHC:6902-DB Evam Nirman Nigam was constituted under Section 3 of U.P. Water Supply and Sewerage Act, 1975. Thus it is a statutory body. Being a statutory body, the affairs of Uttarakhand Peyjal Sansadhan Vikas Evam Nirman Nigam are governed by its own statutory framework.
