This application under Section 407 Cr.P.C. has been filed with the following main prayer(s) :- "For the facts, reasons and circumstances stated in the accompanying affidavit, it is most respectfully prayed that this Hon'ble Court may be kindly be pleased to transferred the criminal Mise case No. 611/11/2024 CNR No. UPBH01007086/2024" Munshi lal Versus State of U.P. and others under section 145 Cr. P.C pending before Additional District and session Judge Bahraich from District Bahraich to another District in the interest of justice. And further prayed that this Hon'ble court may kindly be pleased to stay the further proceeding of criminal Misc case No. 611/11/2024 CNR No. UPBH01007086/2024 Munshi lal Versus State of U.P. and others under section 145 Cr. P.C pending before Additional District and session Judge Bahraich from District Bahraich during pendency of the present petition in the interest of justice." The reason(s) for seeking transfer of the case in issue have been indicated in paragraphs 9 to 11 and 14 of this application, which are extracted herein under:- "9.That the behavior of the learned Additional District and Session Judge Bahraich is not proper with the other counsels as well as parties due to this the some counsels transferred the several case from the court of Additional District and Session Judge Bahraich. The copy of the list of transfer cases is being annexed here with Annexure No. 4 to this affidavit. 10. That if the behavior of the learned Additional District and Session Judge Bahraich is not proper with the petitioner as well as his counsel then the justice did not done to the petitioner. 11. That the learned Additional District and Session Judge is interested for deciding the case in favour of private opposite party and they are fixing the date day today in the present case. 14. That the private opposite parties have approach to the Additional District and Session Judge Bahraich due to this he is interested for deciding the case against petitioner." After considering the averments made in paragraph 11 of the instant application and on being confronted, learned counsel for the applicant prays to withdraw the instant application.
