Petitioner, being one of the legal representatives of original plaintiff-Mr. Prem Singh, has preferred instant writ petition under Article 227 of the Constitution of India, impugning the final order/ judgment dated 05.01.2023 passed by the Revenue Appellate Authority, Ajmer in appeal No.251/2019 under Section 225 of the Rajasthan Tenancy Act, 1955, whereby and whereunder the stay order dated 24.06.2016 has been quashed and set aside and simultaneously, the matter has been remitted to Sub-Divisional Officer, Ajmer for hearing afresh on the application under Section 212 of the Rajasthan Tenancy Act, 1955, after impleadment of appellants (Smt. Sangeeta and Smt. Kamini Bhatia, purchasers of [2025:RJ-JP:15457] (4 of 4) [CW-5863/2023] half share of Khasra No.1843 through registered sale deed dated 17.03.2011) as party to the revenue suit and stay application. 2. Having heard counsel for petitioners and from perusal of the record, it is apparent that the appellants before the Revenue Appellate Authority, Ajmer were purchasers of half portion of Khasra No.1843 through registered sale deed dated 17.03.2011 and revenue suit along with stay application have been filed thereafter on 26.04.2012 that too without impleading the appellants as party therein, in whose favour mutation entries have also been sanctioned in the revenue record. 3. In that view, Revenue Appellate Authority, Ajmer granted indulgence against the injunction order dated 24.06.2016 passed in Lok Adalat. 4. Counsel for petitioners, having argued the writ petition for some time, seeks permission to withdraw the writ petition with liberty to raise his submissions on merits before the Sub-Divisional Officer, while hearing the matter afresh, pursuant to the directions of Revenue Appellate Authority, Ajmer. 5. In view of above, without expressing any opinion on merits, the instant writ petition is disposed of with the liberty as prayed for. 6.
