2025:JHHC:13698 -: 1 :- A.B.A. No. 2575 of 2025 IN THE HIGH COURT OF JHARKHAND AT RANCHI Α.Β.Α. Νο. 2575 of 2025 ---- Raju Kumar Raut son of Sanjay Raut, resident of Argora Bali Bagicha Road, Argora, PO PS Argora, District Ranchi (Jharkhand). … … Petitioner Versus The State of Jharkhand … … Opposite Party ---- CORAM: SRI ANANDA SEN. J. ---- For the Petitioner : Mr. Prakash Jha, Advocate For the State : Mr. Rakesh Ranjan, A.P.P. ---- 3/ 07.05.2025 Learned counsel for the petitioners and learned A.P.P. for the State had argued their respective cases. 2. Through this anticipatory bail application, petitioner, apprehending his arrest, has prayed for grant of anticipatory bail in connection with Argora Police Station Case No.179 of 2024, for allegedly committing offences under Sections 126, 115, 117, 109, 316, 318 and 3 of the Bharatiya Nyaya Sanhita, pending in the Court of the Judicial Magistrate First Class, Ranchi. 3. Learned APP appearing for the state has opposed the prayer for anticipatory bail. 4. The prosecution case is that the informant is a land broker who was supposed to receive ₹45 lakhs by co-accused Mayank Bhushan @ Gunjan Singh for previous business dealings. Despite repeated requests, the money was not paid, and instead, threats were made. On July 11, 2025, Mayank Bhushan, along with the petitioner and another person named Sahil Kumar, came to the informant's house with a pistol. It is alleged that they assaulted the informant with the butt of the pistol, fracturing his nose and injuring his head. The informant was then admitted to Raj Hospital. 5. Learned counsel appearing for the petitioner contended that the petitioner has been falsely implicated in this case by giving criminal colour to a dispute arising out of business transaction. He argued that the First Information Report only shows he was present with co-accused Mayank Bhushan @ Gunjan Singh at the informant’s house, but no specific role or action has been attributed to him. He further contended that the allegations against him are vague and not backed by conclusive evidence. Learned counsel also submitted that the petitioner has no criminal record and is a respected member of society. 2025:JHHC:13698 -: 2 :- A.B.A. No. 2575 of 2025 6. Learned A.P.P. appearing for the State opposed the prayer for grant of anticipatory bail of the petitioner. He submitted that in the supervision note as is recorded at paragraph 31 of the case diary, it has come that there are materials available against the petitioner for offences under Sections 126, 115, 117/3 of the Bharatiya Nyaya Sanhita and on the basis of the medical report Section 109 of the Bharatiya Nyaya Sanhita is also made out. 7. I have gone through the Case Diary. There are materials that have surfaced in course of investigation showing involvement of the petitioner in the crime. The petitioner along with the co-accused trespassed in the house of the informant. They were armed with fire arms. 8. Considering the nature of allegations and the materials surfaced in course of investigation, I find that this is not a fit case for grant of anticipatory bail. Accordingly, prayer for grant of anticipatory bail of the petitioner, abovenamed, in connection with Argora Police Station Case No.179 of 2024, pending in the Court of the Judicial Magistrate First Class, Ranchi is hereby rejected. 9. This anticipatory bail application is, accordingly, dismissed. (Ananda Sen, J.) Kumar/Cp-03
